Terms and conditions
You must read and agree to the terms below before voting in our People's Choice Award for Sculpture in the Garden Wollongong.
- You are invited to vote for your favourite sculpture in the Sculpture in the Garden Wollongong People’s Choice Prize 2025. The sculpture with the largest number of votes will receive the People’s Choice Prize.
- By submitting a vote, you will automatically be entered into a draw (‘the Draw’) to win a voucher from an approved supplier chosen by Council to the value of $200.00 (‘the Prize’). Your vote must comply with these Terms and Conditions to be valid.
- Information on how to enter, prize details and other written information provided by Wollongong City Council (‘Council’) in relation to the Draw form part of these Terms and Conditions.
- By voting for your favourite sculpture, you:
- are bound by the Terms and Conditions;
- if you are the Winner of the Draw:
- agree to participate and co-operate as required in all editorial and media/PR activities relating to the Draw, including but not limited to being interviewed and photographed;
- in the event of any dispute regarding the Terms and Conditions, or any other matter relating to the Draw, the decision of Council will be final. No correspondence will be entered into by Council in relation to the Draw.
- authorise Council to use such footage and photographs together with your name, voice, image and likeness for advertising and/or publicity purposes in any media in perpetuity worldwide without additional compensation.
- The Draw is only open to Australian citizens and permanent residents.
- If you are under 18 years of age, you must have parental/guardian approval to participate. Your parent/guardian must read and consent to these Terms and Conditions.
- Voting opens at 10.00am (AEST) on 1 April 2025 and closes at 5.00pm (AEST) on Wednesday 23 April 2025 (‘Competition Period’).
- Wollongong City Council employees and their immediate family and household members are not eligible to vote for their favourite sculpture. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- Voting opens at 10.00am (AEST) on 1 April 2025 and closes at 5.00pm (AEST) on Wednesday 23 April 2025 (‘Competition Period’).
- You can vote:
- online, via Council’s website; or
- via the QR Code in the catalogue or on signage at Wollongong Botanic Garden.
- You may vote once.
- All valid votes cast during the Competition Period will be entered into the Draw. The Council, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries from any cause.
- Your vote will be deemed invalid if any of the following apply:
- it does not comply with these Terms and Conditions, or
- it is incomplete or indecipherable.
- Council reserves the right, at any time, to verify your details (including your identity and residency status) and to disqualify you if you tamper with the voting process. Failure by Council to enforce any of its rights at any stage does not constitute a waiver of those rights.
- If your details change during the Competition Period, you are responsible for notifying Council. A request to access or modify any information provided in an entry should be directed to Council’s culturaldevelopment@wollongong.nsw.gov.au.
- There is no cost to enter the Draw however internet connection and usage rates may apply. You should obtain details of such costs from your service providers. Council is not and will not be liable for any such costs.
- The Draw will take place at 5.15pm on Wednesday 23 April 2025 at Council’s Administration Building located at 41 Burelli Street, Wollongong NSW 2500.
- The winning entry will be randomly selected from all valid entries in the Draw. The winner shall be the person who is identified by the first valid entry drawn (‘the Winner’).
- Council will notify the Winner by email and / or telephone by 5.30pm on 23 April 2025 (‘the Notification’). Council may also, at its discretion, announce the Winner on its social media channels and / or website.
- Council’s decision in relation to any aspect of the Draw is final and binding and the Council will not enter into any correspondence regarding the result, including in the event of a dispute.
- The Winner must contact Council within 7 days of the Notification to claim the Prize and make arrangements to collect it (‘the Claim Period’). The Prize must be taken as stated, and is not transferable, exchangeable or redeemable for cash.
- The Prize must be collected from Council’s Administration Building within 28 days of the Notification (‘the Collection Period’). Under no circumstances will the Prize be posted to the Winner. If the Winner is under the age of 18, they must be accompanied by their parent or guardian when collecting the Prize.
- The Winner (or, if the Winner is under the age of 18, their parent or guardian) may be required to verify their identity and residency status at the time of collecting the Prize.
- Any ancillary costs associated with redeeming the Prize are not included. Redemption of the Prize is subject to any terms and conditions of the issuer including those specified on the voucher. Council accepts no responsibility if the Winner is unable to:
- attend Council’s Administration Building to claim the prize; or
- redeem the voucher.
- If the Prize is not collected from Council within the Collection Period, Council reserves the right to offer the Prize to a substitute Winner selected in accordance with these Terms and Conditions.
- Once the Prize has left Council’s Administration Building, Council takes no responsibility for the Prize being damaged, lost or stolen.
- Council may cancel or vary the Draw at any time. Council will not be responsible for any loss or costs you may incur in relation to such cancellation or variation.
- By entering the Draw, you release Council from, and indemnify Council against, all liability (including negligence), for any loss or damage or injury whatsoever which is suffered (including, but not limited to, indirect or consequential loss), or for any personal injury suffered or sustained in connection with the Draw, or the use of the Prize, except for any liability which cannot be excluded by law.
- Purpose of collection: Council will collect the personal information of individuals who vote for their favourite Sculpture during the Competition Period in order to be able to contact the Winner when the entry is drawn.
- Intended recipients: Council staff.
- Supply: While the supply of personal information is voluntary, the information provided will enable your participation in the Draw.
- Access / Correction: Your personal information may be accessed by you and Council. A request to access, update or correct any information should be directed to Wollongong City Council.
- Storage: The personal information collected will be stored by Council for the purposes indicated above. However, any personal information may be disclosed as required by law.
